POLICIES AND PAYMENT- SESSION CONTRACT

Kelly Kope Photography.

Below is a basic contract and model release between you and Kelly Kope Photography.

Please read and contact me with any questions you may have. Retainer to secure your spot is non-refundable. Remaining amount to be made when the actual session date is BOOKED.

After you choose your package I won’t be able to upgrade to the next one, extra images are never guarantee. Once images are digitally delivered the images will no longer be edited or replaced. If client requests more editing, there is a fee per image.

Client is not permitted to alter or edit final images in any way, including but not limited to adding social media filters. There is ZERO tolerance for video and photos recording while session is taking place.

Turn around time is 4 weeks after you choose you final images send online.

Locations are chose by me and you will options to pick your location, Traveling outside Surrey/Langley will require an extra fee (please consult me) Session times vary from 1 hour to 2/3 hrs.


RE-SHOOTS & REFUNDS.

The session retainer and the remaining balance are non refundable for any reason. The balance is due at the session date.

Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair, uncooperative siblings or by not following the recommendations of the photographer.

Arriving to sessions at the agreed time is extremely important .If you arrive late your session will not be rescheduled, it will simple result in less images.

If you need to cancel your session 48 hours notice is required. If 48 hours is not given the entire retainer deposit of the session will not be refunded.

Retainers to hold sessions dates are non refundable at any time.

Please understand not all children will pose for pictures the same way, not all of them will smile for photos and I will do my best to make them smile and pose however no poses are never guaranteed. 


LIABILITY.


Client agrees to hold harmless Kelly Kope Photography, its representatives and employees, from any dispute in the event participating parties become injured during the session or while on studio or on-location.

Kelly Kope photography and its representatives will not be held liable for any injury incurred by any participant, or any damage to participants property during the photo session or while on studio or on-location premises.

If the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, or other cause beyond the control Kelly Kope Photography and If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the photo session.

If the digital files have been lost, stolen, or destroyed for reasons beyond Kelly Kope Photography control, including but not limited to camera, hard drive, or equipment malfunction, the liability is limited to the return of all payments received for the photo session.


ARCHIVES.

After 1 month, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by the photographer at the photographer’s sole discretion.

The Photographer is not responsible for loss or damage to the digital files or USB'S due to circumstances beyond photographer’s control.

If digital files are purchased, the photographer is not responsible to keep backups of said digital files past delivery. The photographer recommends that you back up your digital files once they have been delivered to you. 


PRINT RELEASE & COPYRIGHT.


With purchase of high-resolution, digital photographs from a photography session with Kelly Kope Photography, client is hereby granted a license by Kelly Kope Photography to reproduce and display the images in digital or print form, for personal use only.

With the purchase of digital images, Kelly Kope Photography is released from any responsibility for the quality and color of any printed images and/or products that are not produced in a professional photographers print lab.

There is no guarantee that the quality of prints/print products resulting for the use of the purchased digital images will be of equal quality to the digital image provided by Kelly Kope Photography Kelly Kope Photography retains the copyright to all images and derivative works thereof.

License does not include use that results in financial gain, including but not limited to: advertising, print sale profits stock photography, or resale of any nature.

The client agrees that he/she may not alter or edit the images in any way.

The client agrees that he/she may not use any of these images for commercial or editorial purposes, or enter any of these images into competition without the express written permission of Kelly Kope Photography The purchase of digital files releases Kelly Kope photography from any liability due to loss or damage of the images, and also releases Kelly Kope photography from any obligation to maintain copies of any digital file, image, or photograph.

The client is responsible for creating back-ups of the digital content.

The client hereby grants to Kelly Kope photography the right to use and publish images taken to further promote its service, including portfolio, web site, display, advertisement, and editorial use.

It is illegal to copy, scan, download, print or otherwise use any image created by Kelly Kope photography during client’s photo session without a valid print release.

This applies to "sneak peek" images, images posted in an online proofing gallery, Facebook, or hard copy images.

The Client may share proofing gallery links as well as any Kelly Kope photography social media posts and is encouraged to tag themselves in Facebook Page posts if desired. It is also illegal to alter or edit images created by Kelly Kope photography.

This applies but not limited to Instagram filters or the use of any type of editing software. Using a cellphone or any type of camera to take photographs is prohibited during a session with Kelly Kope photography.
